Terms & Conditions.

These terms govern use of vidcomphoto.com and requests made through the website. A signed proposal, school agreement, order form or service contract may contain additional terms for a specific project.

1. Acceptance and eligibility

By using this website or submitting a request, you agree to these Terms & Conditions. If you submit on behalf of an organization, school, team, family member or another person, you represent that you are authorized to do so.

This website is intended for adults and authorized users. A child under 13 must not submit personal information through the website; a parent or guardian should submit the request.

2. Website inquiries are not bookings

A form submission, email, estimate or availability response does not reserve a date or create a service contract. A booking becomes binding only when Vidcom confirms it under the applicable proposal, invoice, order form or written agreement and any required payment has been received.

Project scope, deliverables, schedule, fees, deposits, cancellation terms, rescheduling, travel, turnaround time and usage rights are governed by the project-specific agreement.

3. Accurate and authorized information

You agree to provide accurate information and to submit only information, photographs, names, access codes and other material that you are authorized to provide. Gallery requests may require identity, relationship or authorization verification before access is given.

Private galleries

An access request does not guarantee access. Vidcom may delay or decline delivery when identity, authority or gallery ownership cannot be verified.

4. School and student services

When Vidcom performs services for a school or educational agency, the school’s written agreement, data privacy addendum, Parents’ Bill of Rights supplemental information and other contract documents control the handling of covered student data. See the Student Data Privacy Notice.

Parents and eligible students should direct formal education-record access, correction or complaint requests to the applicable school or district, which can verify identity and coordinate with Vidcom.

5. Intellectual property

The website design, Vidcom branding, text, graphics, demonstrations, photographs, videos and other content are owned by Vidcom or used with permission and are protected by applicable law. You may not copy, scrape, republish, sell, reverse engineer or commercially exploit website content without written permission.

Rights to project photographs and videos—including personal-use licenses, print rights, promotional permissions and restrictions—are determined by the applicable service agreement, gallery license or order terms.

6. Acceptable use

You may not use this website or any gallery to:

  • seek unauthorized access to another person’s images or information;
  • share an access code with someone who is not authorized;
  • upload malicious code, disrupt the service, probe security or evade access controls;
  • misrepresent your identity, parental relationship or authority; or
  • violate privacy, publicity, intellectual-property or other legal rights.

7. Third-party services

The website may link to third-party services such as payment providers, gallery platforms, social media, Relor Live and Vidcom Found U. Those services have their own terms and privacy practices. Vidcom is not responsible for third-party services outside its control, except as required by law or a written agreement.

8. Website availability and disclaimers

Vidcom works to keep the website accurate and available, but does not promise uninterrupted access or that every item will be error-free. Website information may change, and service descriptions or starting prices are not binding quotations.

To the fullest extent permitted by law, the website is provided “as is” and “as available.” Nothing in these terms excludes a right or remedy that cannot legally be excluded.

9. Limitation of liability

To the fullest extent permitted by law, Vidcom will not be liable for indirect, incidental, special, consequential or punitive damages arising solely from use of—or inability to use—the public website. Liability relating to a paid project is governed by the applicable written agreement. These limitations do not apply where prohibited by law.

10. Governing law and changes

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute not governed by a separate written agreement will be brought in a court of competent jurisdiction in New York.

Vidcom may update these terms prospectively. The effective date at the top identifies the current version. Material changes will be posted on this page.
